Terms of Service

Daisy is a password-protected sales intelligence and account prioritisation platform operated by The Trustee for JustJewels Master Trust (ABN 21 934 137 134), trading as The Demand Stream. In these terms, “The Demand Stream” means that entity.

By subscribing to Daisy, your organisation is purchasing access to Daisy for the agreed subscription period, user allowance, pricing and scope shown on this page, in your order form, proposal, invoice, statement of work or services agreement.

Daisy may provide access to account intelligence, contact information, sales signals, recommended actions, suggested outreach content, dashboards, reports and related support services.

Daisy is designed to assist business-to-business sales, marketing and pipeline development. It does not guarantee meetings, opportunities, sales, revenue, data completeness, data accuracy or prospect readiness.

Your organisation is responsible for:

• ensuring Daisy is used only for lawful business purposes;
• ensuring authorised users comply with the Daisy End-User Terms of Use;
• reviewing and approving any Daisy-generated recommendations or suggested outreach before use;
• ensuring any client-provided data has been lawfully collected and may be used for the agreed purposes;
• complying with applicable privacy, spam, direct marketing, telecommunications and platform rules;
• managing opt-outs, unsubscribes, suppression lists and do-not-contact requests.

Daisy is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, The Demand Stream excludes all warranties, representations and guarantees not expressly stated in these terms.

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.

To the maximum extent permitted by law, your organisation indemnifies The Demand Stream against any claim, loss, liability, penalty, damage or cost, including reasonable legal costs, arising from:

• your organisation’s or its users’ use of Daisy in breach of these terms;
• any unlawful, misleading, non-compliant or inappropriate outreach;
• any breach of privacy, spam, direct marketing, telecommunications or platform rules by your organisation or its users;
• any use of client-provided data that was not lawfully collected, supplied or authorised for the agreed purposes;
• any external communication, campaign or action taken by your organisation using Daisy outputs.

This indemnity does not apply to the extent the claim, loss, liability, penalty, damage or cost is directly caused by The Demand Stream’s fraud, wilful misconduct or breach of these terms.

To the maximum extent permitted by law, and subject to any rights you have under the Australian Consumer Law or any other law that cannot be excluded, The Demand Stream’s total liability arising out of or in connection with Daisy is limited to the fees paid by your organisation for Daisy in the 12 months before the event giving rise to the liability.

To the maximum extent permitted by law, The Demand Stream is not liable for any indirect, consequential, special or incidental loss, or for any loss of profit, revenue, data, goodwill, anticipated savings or business opportunity.

The Demand Stream owns Daisy and all related intellectual property, including its workflows, dashboards, prompts, methods, signal logic, recommendations, templates, processes and operating model.

Your organisation receives a limited right to access and use Daisy during the agreed subscription period. Your organisation must not copy, reproduce, reverse engineer, resell, sublicense or recreate Daisy or any part of The Demand Stream’s intellectual property without written permission.

Your organisation retains ownership of data it provides to Daisy.

The Demand Stream may use, host, process, organise, analyse and display that data as required to provide Daisy and related services.

Unless otherwise agreed in writing, The Demand Stream may use aggregated, anonymised or de-identified information to improve Daisy and its services, provided that such information does not identify your organisation, authorised users or individual business contacts.

Fees, payment terms, subscription period, renewal terms, cancellation rights, user limits and support arrangements are as stated in the applicable order form, proposal, invoice, statement of work or services agreement, including the subscription summary shown on this page.

Unless otherwise agreed in writing, fees are payable for the agreed subscription period regardless of user activity, sales outcomes, lead conversion, meetings booked or revenue generated.

Unless otherwise stated on this page or agreed in writing, the subscription is monthly: it renews automatically each month, and your organisation may cancel at any time with effect from the end of the then-current monthly billing period. Fees already paid are non-refundable except as required by law, including the Australian Consumer Law.

Payments are processed by Stripe and are received by The Trustee for JustJewels Master Trust, which also trades as Storytllr Group. Your payment receipts and card or bank statements may show the name Storytllr Group.

On expiry or termination of the subscription, access to Daisy will cease.

On written request within 30 days after expiry or termination, The Demand Stream will return or delete client-provided data, except where retention is required by law, for legitimate business records, for security or audit purposes, or to record an opt-out, unsubscribe, suppression or do-not-contact request.

If there is a conflict between these terms and a signed agreement with The Demand Stream, the signed agreement will apply to the extent of the conflict.

These terms are governed by the laws of New South Wales, Australia.

The parties submit to the exclusive jurisdiction of the courts of that State.

By accepting these terms, you confirm that you are authorised to purchase, approve or subscribe to Daisy on behalf of your organisation.
